The arbitration shall take place in Songyuan, Jilin Province, China, and shall be conducted in the English language. The arbitral award shall be final and binding on both parties and may be entered and enforced in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of the dispute through negotiation or arbitration.

11. Severability and waiver

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The invalidity of any provision shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect.

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. No waiver of any breach of these terms shall be deemed a waiver of any subsequent breach.
